3AM Privacy Policy
Last updated: 16 October 2026
This Privacy Policy governs the 3AM application — a sleep companion and sleep tracking application with offline AI. It is also published as Part 2 of our 3AM Terms of Service.
1. Introduction
2. Our Privacy-First Commitment
3AM is built on a simple principle: your data stays on your device. Everything the App does — including sleep tracking, sound analysis, sensor measurement, and artificial intelligence processing — happens locally on your phone. Nothing is uploaded, transmitted, or synced to us or to any third party.
We do not operate servers that receive your sleep data. We do not have accounts, cloud storage, or remote databases containing your information. We cannot see your sleep records, your audio, your sensor readings, or your insights — because they never leave your device.
This approach — privacy by design and by default — means that for most of the information the App processes, there is simply nothing for us to collect, use, disclose, or protect, because we never receive it in the first place.
3. How 3AM Processes Data (Sensors and Artificial Intelligence)
To provide its sleep companion and sleep tracking features, the App accesses the following device capabilities. In every case, the data is processed locally on your device and is not transmitted to us or any third party:
3.1 Microphone
With your permission, the App may access your device’s microphone to analyse sounds during your sleep — such as snoring, breathing patterns, and environmental noise — in order to provide sleep analysis and companion features. Audio is processed in real time on your device. It is not recorded, stored, or transmitted to us or to any third party, and we cannot access it.
3.2 Accelerometer (Motion Sensor)
With your permission, the App may access your device’s accelerometer to detect movement during your sleep — such as position changes and restlessness — in order to provide sleep tracking and analysis. Motion data is processed locally on your device and is not transmitted to us or to any third party.
3.3 Light Sensor
With your permission, the App may access your device’s light sensor to measure ambient light levels — for example, to help analyse your sleep environment and correlate light exposure with sleep quality. Light sensor readings are processed locally on your device and are not transmitted to us or to any third party.
3.4 On-Device Artificial Intelligence
3AM uses artificial intelligence models to analyse your sleep patterns and generate insights, summaries, and recommendations. These AI models run entirely on your device (on-device inference). No data — including your audio, sensor readings, or sleep records — is sent to any external server, cloud service, or third-party AI provider for processing. Your data is never used to train our models or anyone else’s models.
4. Information We Collect
4.1 We do not collect personal information through the App. The App is designed so that all data it processes — microphone input, accelerometer readings, light sensor readings, sleep records, and AI-generated insights — remains on your device and under your control. We do not receive, collect, transmit, or store this information on our systems.
4.2 No accounts, no registration. The App does not require you to create an account, and we do not collect your name, email address, phone number, or any similar identifiers through the App.
4.3 If you contact us. If you contact us for support or with questions (for example, by email to support@baseanalytics.com.au), we will receive the information you choose to include in your communication, such as your email address and the contents of your message. We use this information solely to respond to you and for related support purposes.
4.4 App store platforms. When you download the App through a third-party platform (such as the Apple App Store or Google Play), that platform may collect information in accordance with its own privacy policy, including download statistics and crash reports. This is outside our control and is not linked to us by us.
5. Permissions We Request
The App requests access to the following device capabilities, which are used exclusively for the purposes described in Section 3 and can be controlled by you at any time:
- Microphone: to analyse sounds during sleep (such as snoring and breathing patterns) for sleep tracking and companion features — processed in real time on your device;
- Motion / accelerometer: to detect movement during sleep for sleep tracking and analysis — processed on your device;
- Light sensor: to measure ambient light levels for sleep environment analysis — processed on your device.
You can grant or revoke these permissions at any time through your device settings. If you revoke a permission, the related features of the App may not function, but the App will remain usable to the extent possible.
6. How Your Data Is Stored
All data processed or generated by the App is stored locally on your device. Your sleep records and insights are protected by your device’s built-in security features, including device-level encryption where enabled on your device.
We cannot access this data, and since we do not receive it, there is no copy of it on any server, cloud service, or backup system operated by us.
You remain in control of your data at all times. You can delete your data at any time by clearing the App’s data or uninstalling the App from your device. If you use device-level backup services (such as iCloud or Google backups), your device backup settings determine whether App data is included in backups, and such backups are governed by the backup provider’s terms and privacy policy, not ours.
7. Data Sharing and Disclosure
We do not sell, rent, trade, or otherwise share your personal information. Because we do not receive or store your data on our systems, there is no data for us to share, sell, or disclose to advertisers, data brokers, analytics providers, or any other third party.
The App does not contain third-party advertising and does not share your information with advertising networks or data brokers.
8. Data Retention
We retain no data about you on our systems in connection with the App, because we do not receive any. Your data persists on your device for as long as you choose to keep it and is deleted when you clear the App’s data, uninstall the App, or delete the underlying records.
If you contact us for support, we retain the correspondence (including your email address) for as long as reasonably necessary to handle your request and for a reasonable period afterwards for record-keeping purposes, after which it is deleted.
9. Tracking and Analytics
The App does not use cookies, advertising identifiers, tracking pixels, or third-party analytics or tracking technologies. We do not track your activity within the App, we do not build user profiles, and we do not deliver targeted advertising. There is no tracking to opt out of because none exists.
10. Data Security
Because 3AM processes your data locally on your device, the risk of data exposure in transit or on remote servers is eliminated by design. There is no transmission of your sleep data over the internet, and there is no cloud storage of your data by us that could be breached.
The security of your data depends on the security of your device. We recommend that you protect your device with a passcode, biometric authentication, and keep your operating system up to date.
While we design the App with privacy and security in mind, no method of electronic storage is completely secure. You acknowledge and accept the inherent risks of storing data on your device.
11. International Data Transfers
Because we do not receive, collect, or store your data on our systems, we do not transfer your personal information internationally. If you contact us for support, your correspondence may be processed in Australia, where we are based.
12. Your Rights
Under applicable privacy laws, including the Australian Privacy Act 1988 (Cth) and, where applicable, the GDPR, you may have rights regarding your personal information, including rights of access, correction, deletion, restriction, portability, objection, and withdrawal of consent.
Because the App keeps your data on your device and we do not receive it, you can exercise most of these rights directly: you can access, correct, export, or delete your data at any time through the App and your device settings. We cannot access, correct, export, or delete data that we do not hold.
If you have contacted us, you can ask us to access, correct, or delete the correspondence we hold about you by contacting us using the details in Section 15 below.
Where the GDPR applies to any processing we carry out (for example, handling your support correspondence), our legal bases are: your consent; the performance of a contract with you or steps at your request before entering a contract; our legitimate interests in operating and supporting the App, provided such interests are not overridden by your rights and interests; and compliance with legal obligations. You have the right to withdraw consent at any time where processing is based on consent, without affecting the lawfulness of processing based on consent before its withdrawal. You also have the right to lodge a complaint with the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au or by calling 1300 363 992, or with your local data protection authority in the EEA or UK.

14. Changes to This Privacy Policy
We reserve the right to modify, amend, or update this Privacy Policy at any time. We will notify you of material changes by posting the updated Privacy Policy on this page and updating the “Last updated” date. Where required by law, we will provide more prominent notice.
We encourage you to review this Privacy Policy periodically.
